ANWENDUNG: Diese Lizenz gilt für die oben aufgeführten Software-Produkte für Windows® und Mac® , die in einem Land erworben wurden, für das in diesem Dokument keine spezifischen Lizenzbedingungen enthalten sind.

 

WICHTIG – Bitte lesen Sie die vorliegende Vereinbarung („Vereinbarung“) sorgfältig durch, bevor Sie das/die Softwareprogramm(e) installieren.  Mit der Installation oder anderweitigen Nutzung des Softwareprogramms/der Softwareprogramme erklären Sie sich damit einverstanden, durch die vorliegenden Lizenzbedingungen gebunden zu sein. Sollten Sie den vorliegenden Lizenzbedingungen nicht zustimmen, geben Sie bitte dieses Paket mit seinem vollständigen Inhalt an den Verkäufer zurück, bei dem Sie es erworben haben, um eine volle Erstattung zu erhalten.

 

Das/die Softwareprogramm(e) für diese Installation sowie jegliche zugehörige Dokumentation  werden nicht verkauft, sondern durch Texas Instruments Incorporated („TI“) und/oder entsprechende Lizenzgeber (im Folgenden zusammenfassend bezeichnet als „Lizenzgeber“) lizenziert.  Im Folgenden werden die Einzelheiten zu der gewährten Lizenz aufgeführt.

 

Definitionen:

Autorisierte Computer –

Computer, die im Eigentum einer Bildungseinrichtung stehen oder von dieser geleast wurden und diesem Institut zugeteilt wurden und/oder Computer, die im Eigentum eines Studierenden/Schülers stehen, für die Nutzung durch diesen Studierenden/Schüler während der Dauer der Zugehörigkeit zu diesem Institut. Alle solche Computer sind autorisierte Computer.

Programm –

Das/die Softwareprogramm(e) für diese Installation sowie sämtliche zugehörige Dokumentation.

Institut –

Der physische Campus einer Bildungseinrichtung, die durch eine vom U.S. Department of Education oder dem State Board of Education bzw. durch deren Entsprechungen in anderen Ländern anerkannte Vereinigung akkreditiert ist.

Nutzungszeitraum –

Der Zeitraum, der im Dokument mit dem Software-Aktivierungsschlüssel genannt ist, welches in diesem Paket enthalten ist oder Ihnen von TI zugesandt wurde.

Virtuelle Nutzung –

Gleichzeitige Nutzung des Programms durch zwei oder mehr Benutzer.

 

PROBELIZENZ

Sie erhalten die folgenden eingeschränkten Rechte, wenn Sie das Programm als Testversion im Internet von der Website education.ti.com oder auf einer von TI vertriebenen Demo-CD erworben haben. Der Lizenzgeber gewährt Ihnen für einen Testzeitraum, der an dem Datum beginnt, an dem Sie das Programm installieren und für die im Programm von TI gewährte Anzahl von Tagen gilt, eine persönliche, einfache, nicht übertragbare Lizenz zur Installation und Nutzung des Programms auf einem einzelnen Autorisierte Computer. Sie dürfen von der Software keine Kopien für Backup- oder Archivierungszwecke erstellen.  Die virtuelle Nutzung ist ausdrücklich untersagt.  Sie dürfen keine zugehörige, gemeinsam mit einer Demo-CD bereitgestellte Softwaredokumentation vervielfältigen.  Sie erklären sich einverstanden, die Nutzung des Programms nach Ablauf des Testzeitraums einzustellen, sofern Sie keine Lizenz zur Nutzung des Programms erworben haben.

Sie erklären sich einverstanden, den Softwareprogrammteil des Programms nicht zu disassemblieren oder zu dekompilieren.  Sie dürfen das Programm sowie Kopien, sei es vollständig oder teilweise, weder verkaufen noch vermieten, zum Leasing bereitstellen oder anderweitig übertragen.

Während des Testzeitraums sind Sie außerdem zur Nutzung jeder Calculator-Anwendung („App“) von TI, für die Sie eine gültige Lizenz besitzen, mit dem Programm berechtigt.  Sie dürfen eine solche App von Ihrem Calculator auf den Computer, auf dem das Programm installiert ist, kopieren. 

 

Entsprechend dem gekauften Lizenztyp gelten folgende Lizenzbedingungen: 

 

EINZELNUTZERLIZENZ/UNBESCHRÄNKTE LAUFZEIT

Nach Erhalt eines Software-Aktivierungsschlüssels für dieses Programm durch TI gewährt Ihnen der Lizenzgeber eine persönliche, einfache, nicht übertragbare Lizenz für die Installation und Nutzung des Programms auf einem einzelnen Computer. Die virtuelle Nutzung ist ausdrücklich untersagt. Sie dürfen von der Software eine Kopie für Backup- oder Archivierungszwecke erstellen. Sie stimmen zu, sämtliche in der Software und auf den Medien angezeigten Copyright-Vermerke und Vermerke zu Eigentumsrechten zu vervielfältigen.  Sofern nicht ausdrücklich in der Dokumentation angegeben, dürfen Sie eine solche Dokumentation nicht vervielfältigen.

 

EINZELNUTZER-LIZENZ MIT BESCHRÄNKTER LAUFZEIT

Nach Erhalt eines Software-Aktivierungsschlüssels für dieses Programm durch TI gewährt Ihnen der Lizenzgeber eine persönliche, einfache, nicht übertragbare Lizenz für die Installation und Nutzung des Programms auf einem einzelnen Computer für die Dauer des Nutzungszeitraums. Die virtuelle Nutzung ist ausdrücklich untersagt. Sie dürfen von der Software eine Kopie für Backup- oder Archivierungszwecke erstellen. Sofern keine Erneuerung des Abonnements erfolgt, muss das Programm nach Ablauf des Nutzungszeitraums von dem/den Computer(n), auf dem/denen es installiert wurde, entfernt werden.  In diesem Fall garantieren Sie, dass eine solche Entfernung erfolgt und bescheinigen Sie dies dem Lizenzgeber in schriftlicher Form. Sie stimmen zu, sämtliche in der Software und auf den Medien angezeigten Copyright-Vermerke und Vermerke zu Eigentumsrechten zu vervielfältigen.  Sofern nicht ausdrücklich in der Dokumentation angegeben, dürfen Sie eine solche Dokumentation nicht vervielfältigen.

 

MEHRBENUTZERLIZENZ / UNBESCHRÄNKTE LAUFZEIT

Bei der Mehrbenutzerlizenz / Lizenz mit unbeschränkter Laufzeit gewährt Ihnen der Lizenzgeber eine zeitlich unbeschränkte, einfache, nicht übertragbare Lizenz zur Installation des Programms auf einer gemäß der erworbenen Lizenz zugelassenen Anzahl autorisierter Computer.  Mit der Mehrbenutzerlizenz/Lizenz mit unbeschränkter Laufzeit wird einem Studierenden/Schüler oder Fakultätsmitglied der Bildungseinrichtung, der/das einen autorisierten Computer benutzt, auf dem das Programm rechtmäßig gemäß der vorliegenden Vereinbarung installiert ist, das Recht gewährt, das Programm zu nutzen. 

Sie garantieren, dass Sie alle angemessenen Bemühungen unternehmen, das Programm von sich im Besitz von Studierenden/Schülern befindlichen Computern zu entfernen, bevor der jeweilige Studierende/Schüler seinen Abschluss erlangt oder von der Bildungseinrichtung abgemeldet/exmatrikuliert wird (je nachdem, welcher Fall früher eintritt), und diesen Studierenden/Schüler über die Beendigung seines Rechts auf Nutzung des gemäß der vorliegenden Vereinbarung installierten Programms zu informieren. Sie dürfen von der Software eine Kopie für Backup- oder Archivierungszwecke erstellen. Sie stimmen zu, sämtliche in der Software und auf den Medien angezeigten Copyright-Vermerke und Vermerke zu Eigentumsrechten zu vervielfältigen.  Sofern nicht ausdrücklich in der vorliegenden Vereinbarung oder in der Dokumentation angegeben, dürfen Sie eine solche Dokumentation nicht vervielfältigen.  Jeder autorisierte Computer, auf dem das Programm installiert ist, muss einem Institut zugewiesen sein.  In einigen Regionen ist es möglicherweise erforderlich, das Programm mit Mehrbenutzerlizenz/Lizenz mit unbeschränkter Laufzeit jährlich zu reaktivieren.  Die Reaktivierung erfolgt vor Ablauf der Lizenz. Bitte kontaktieren Sie zur Reaktivierung Ihres Programms TI unter education.ti.com/support.

 

MEHRBENUTZERLIZENZ / BESCHRÄNKTE LAUFZEIT

Bei der Mehrbenutzerlizenz/Lizenz mit befristeter Nutzung gewährt Ihnen der Lizenzgeber eine einfache, nicht übertragbare Lizenz zur Installation des Programms auf einer gemäß der erworbenen Lizenz zugelassenen Anzahl autorisierter Computer.  Mit der Mehrbenutzerlizenz/Lizenz mit befristeter Nutzung wird einem Studierenden/Schüler oder Fakultätsmitglied der Bildungseinrichtung, der einen autorisierten Computer benutzt, auf dem das Programm rechtmäßig gemäß der vorliegenden Vereinbarung installiert ist, das Recht gewährt, das Programm zu nutzen. 

Sie garantieren, dass Sie alle angemessenen Bemühungen unternehmen, das Programm von dem sich im Besitz des Studierenden/Schülers befindlichen Computer zu entfernen, bevor dieser Studierende/Schüler seinen Abschluss erlangt oder von der Bildungseinrichtung abgemeldet wird (je nachdem, welcher Fall früher eintritt), und diesen Studierenden/Schüler über die Beendigung seines Rechts auf Nutzung des gemäß der vorliegenden Vereinbarung installierten Programms zu informieren. Sie dürfen von der Software eine Kopie für Backup- oder Archivierungszwecke erstellen. Sie stimmen zu, sämtliche in der Software und auf den Medien angezeigten Copyright-Vermerke und Vermerke zu Eigentumsrechten zu vervielfältigen.  Sofern nicht ausdrücklich in der vorliegenden Vereinbarung oder in der Dokumentation angegeben, dürfen Sie eine solche Dokumentation nicht vervielfältigen.  In den Fällen, in denen TI die entsprechende Dokumentation elektronisch bereitstellt, dürfen Sie pro autorisierten Computer eine Kopie von der Dokumentation erstellen.  Jeder autorisierte Computer, auf dem das Programm installiert ist, muss einem Institut zugewiesen sein.  Nach Ablauf des Nutzungszeitraums wird das Programm automatisch deaktiviert.

 

CONCURRENT-LIZENZ / UNBESCHRÄNKTE LAUFZEIT

Der Lizenzgeber gewährt Ihnen eine zeitlich unbeschränkte, einfache, nicht übertragbare Lizenz zur Installation des Programms auf sämtlichen autorisierten Computern.  Mit der Concurrent-Lizenz/Lizenz mit unbeschränkter Laufzeit wird jedem Studierenden/Schüler oder Fakultätsmitglied der Bildungseinrichtung, der/das einen autorisierten Computer benutzt, auf dem das Programm rechtmäßig nach der vorliegenden Vereinbarung installiert ist, das Recht gewährt, das Programm zu nutzen, wobei die maximale Anzahl an gleichzeitigen Benutzern zu jeder Zeit auf die in der von Ihnen erworbenen Lizenz genannten Anzahl an gleichzeitigen Benutzern beschränkt ist. 

Sie garantieren, dass Sie angemessene, überprüfbare Maßnahmen ergreifen und umsetzen, um die maximale Anzahl an gleichzeitigen Benutzern auf die Anzahl zu beschränken, die gemäß der von TI erworbenen Lizenz zugelassenen ist.  Sie garantieren, dass Sie alle angemessenen Bemühungen unternehmen, das Programm von sich im Besitz von Studierenden/Schülern befindlichen Computern zu entfernen, bevor der jeweilige Studierende/Schüler seinen Abschluss erlangt oder von der Bildungseinrichtung abgemeldet/exmatrikuliert wird (je nachdem, welcher Fall früher eintritt), und den jeweiligen Studierenden/Schüler über die Beendigung seines Rechts auf Nutzung des gemäß der vorliegenden Vereinbarung installierten Programms zu informieren. Sie dürfen von der Software eine Kopie für Backup- oder Archivierungszwecke erstellen. Sie stimmen zu, dabei sämtliche in der Software und auf den Medien angezeigten Copyright-Vermerke und Vermerke zu Eigentumsrechten zu vervielfältigen.  Sofern nicht ausdrücklich in der vorliegenden Vereinbarung oder in der Dokumentation angegeben, dürfen Sie eine solche Dokumentation nicht vervielfältigen.  In den Fällen, in denen TI die entsprechende Dokumentation elektronisch bereitstellt, dürfen Sie pro autorisierten Computer eine Kopie von der Dokumentation erstellen.  Jeder autorisierte Computer, auf dem das Programm installiert ist, muss einem Institut zugewiesen sein.

 

CONCURRENT-LIZENZ / BESCHRÄNKTE LAUFZEIT

Der Lizenzgeber gewährt Ihnen eine einfache, nicht übertragbare Lizenz zur Installation des Programms auf sämtlichen autorisierten Computern.  Mit der Concurrent-Lizenz/Lizenz mit befristeter Nutzung wird jedem Studierenden/Schüler oder Fakultätsmitglied der Bildungseinrichtung, der/das einen autorisierten Computer benutzt, auf dem das Programm rechtmäßig gemäß der vorliegenden Vereinbarung installiert ist, das Recht gewährt, das Programm zu nutzen, wobei die maximale Anzahl an Benutzern zu jeglicher Zeit auf die in der von Ihnen erworbenen Lizenz genannte Anzahl an gleichzeitigen Benutzern beschränkt ist.

Sie garantieren, dass Sie angemessene, überprüfbare Maßnahmen ergreifen und umsetzen, um die maximale Anzahl an gleichzeitigen Benutzern auf die Anzahl zu beschränken, die gemäß der von TI erworbenen Lizenz zugelassen ist. Sie garantieren, dass Sie alle angemessenen Bemühungen unternehmen, das Programm von dem sich im Besitz des Studierenden/Schülers befindlichen Computer zu entfernen, bevor dieser Studierende/Schüler seinen Abschluss erlangt oder von der Bildungseinrichtung abgemeldet wird (je nachdem, welcher Fall früher eintritt), und diesen Studierenden/Schüler über die Beendigung seines Rechts auf Nutzung des gemäß der vorliegenden Vereinbarung installierten Programms zu informieren. Sie dürfen von der Software eine Kopie für Backup- oder Archivierungszwecke erstellen. Sie stimmen zu, dabei sämtliche in der Software und auf den Medien angezeigten Copyright-Vermerke und Vermerke zu Eigentumsrechten zu vervielfältigen.  Sofern nicht ausdrücklich in der vorliegenden Vereinbarung oder in der Dokumentation angegeben, dürfen Sie eine solche Dokumentation nicht vervielfältigen.  In den Fällen, in denen TI die entsprechende Dokumentation elektronisch bereitstellt, dürfen Sie pro autorisierten Computer eine Kopie von der Dokumentation erstellen.  Jeder autorisierte Computer, auf dem das Programm installiert ist, muss einem Institut zugewiesen sein. Nach Ablauf des Nutzungszeitraums wird das Programm automatisch deaktiviert.

 

Zusätzliche, für alle Lizenzen geltenden Bedingungen:

Sie erklären sich einverstanden, den Softwareprogrammteil des Programms nicht zu disassemblieren oder zu dekompilieren.  Diese Lizenz endet automatisch in dem Fall, in dem Sie versuchen, den Softwareprogrammteil des Programms zu disassemblieren oder zu dekompilieren oder im Softwareprogrammteil enthaltene Softwareschutzmechanismen zu umgehen.  Sie dürfen das Programm sowie Kopien, sei es vollständig oder teilweise, weder verkaufen noch vermieten, zum Leasing bereitstellen oder anderweitig übertragen.

In den Fällen, in denen TI die entsprechende Dokumentation elektronisch bereitstellt, dürfen Sie pro autorisierten Computer eine Kopie von der Dokumentation erstellen und diese ausdrucken.

TI behält sich das Recht vor, Ihre Installation des Programms zu prüfen, um sicherzustellen, dass Sie die gewährten Lizenzbedingungen einhalten; durch Annahme dieser Lizenz stimmen Sie einer solchen Prüfung durch TI zu. Ergibt eine Prüfung, dass die gewährten Lizenzbedingungen nicht eingehalten werden, kann TI nach eigenem Ermessen (a) Ihre Lizenz unverzüglich beenden oder (b) Ihnen den Betrag, den Sie TI im Falle des Erwerbs einer passenden Lizenz schulden würden, in Rechnung stellen.  Entscheidet sich TI, Ihnen eine solche Rechnung auszustellen, stimmen Sie zu, diese innerhalb von dreißig (30) Tagen ab ihrem Erhalt zu begleichen.  

Bei Einhaltung der Lizenzbestimmungen sind Sie außerdem zur Nutzung jeglicher Calculator-Anwendung (App) von TI, für die Sie eine gültige Lizenz besitzen, gemeinsam mit dem Programm berechtigt.  Sie dürfen eine solche App von Ihrem Calculator auf den Computer, auf dem das Programm installiert ist, kopieren.

 

HAFTUNGSAUSSCHLUSS SOWIE AUSSCHLUSS VON SCHADENERSATZ UND BESCHRÄNKUNGEN

Garantie:  Der Lizenzgeber garantiert nicht, dass das Programm frei von Fehlern ist oder Ihre spezifischen Anforderungen erfüllt. Keine Erklärung bezüglich des Nutzens dieses Programms ist als ausdrückliche oder stillschweigende Garantie auszulegen.

DER LIZENZGEBER GIBT WEDER EINE ZUSICHERUNG BEZÜGLICH DER EIGENSCHAFTEN DES PROGRAMMS NOCH EINE GARANTIE, SEI ES AUSDRÜCKLICH ODER STILLSCHWEIGEND, DARIN EINGESCHLOSSEN STILLSCHWEIGENDE ZUSICHERUNGEN ODER GARANTIEN, DASS DAS PROGRAMM VON DURCHSCHNITTLICHER QUALITÄT UND FÜR DEN NORMALEN GEBRAUCH ODER FÜR EINEN SPEZIELLEN ZWECK GEEIGNET IST, ODER DER NICHT-VERSTOSS BEZÜGLICH DES PROGRAMMS, UND STELLT DAS PROGRAMM OHNE MÄNGELGEWÄHR ZUR VERFÜGUNG.

Obwohl keine Garantie für das Programm übernommen wird, werden die Datenträger, sofern Ihnen das Programm auf CD geliefert wurde, ersetzt, wenn auf diesen Datenträgern innerhalb der ersten neunzig (90) Tage der Nutzung Fehler festgestellt und die Datenträger (Fracht vorausbezahlt) an TI zurückgeschickt werden. DER VORLIEGENDE ABSATZ DEFINIERT DEN MAXIMALEN HAFTUNGSUMFANG UND IHR EINZIGES UND ALLEINIGES RECHTSMITTEL ALS KUNDE IM FALLE VON BESCHÄDIGTEN DATENTRÄGERN. 

Der Kaufbeleg ist vorzulegen.

DER LIZENZGEBER HAFTET NICHT FÜR MÄNGEL, DIE DURCH DIE NUTZUNG DES PROGRAMMS ENTSTANDEN SIND ODER IHNEN ODER ANDEREN ENTSTEHEN, DARIN EINGESCHLOSSEN KONKRETE, MITTELBARE, BEILÄUFIG ENTSTANDENE SCHÄDEN ODER FOLGESCHÄDEN, AUCH DANN NICHT, WENN DER LIZENZGEBER AUF DIE MÖGLICHKEIT SOLCHER SCHÄDEN HINGEWIESEN WURDE.

DA IN EINIGEN STAATEN ODER ZUSTÄNDIGKEITSGEBIETEN DER AUSSCHLUSS ODER DIE BESCHRÄNKUNG VON BEILÄUFIG ENTSTANDENEN SCHÄDEN ODER FOLGESCHÄDEN NICHT ZULÄSSIG IST, TREFFEN DIE OBEN GENANNTEN BESCHRÄNKUNGEN ODER AUSSCHLÜSSE GGF. NICHT AUF SIE ZU.

DIE GESAMTE HAFTUNG DES LIZENZGEBERS NACH DER VORLIEGENDEN LIZENZ IST AUF 500 (FÜNFHUNDERT) USD BESCHRÄNKT.  

DIE OBEN GENANNTEN HAFTUNGSBESCHRÄNKUNGEN FÜR SCHÄDEN GELTEN NICHT IM FALLE VON DURCH DEN LIZENZGEBER VERSCHULDETER KÖRPERVERLETZUNG, IM FALLE VON SCHÄDEN AUFGRUND VON GROBER FAHRLÄSSIGKEIT DES LIZENZGEBERS ODER VORSATZ ODER FALLS DER LIZENZGEBER NACH PRODUKTHAFTUNGSGESETZEN HAFTET.

 

ALLGEMEINE BESTIMMUNGEN

(1) Bei Nichteinhaltung der hier genannten Lizenzbedingungen ist TI zur sofortigen Kündigung dieser Lizenzvereinbarung aus wichtigem Grund berechtigt. Sie verpflichten sich, bei Beendigung dieser Lizenzvereinbarung die Originalpackung und alle in Ihrem Besitz befindlichen vollständigen oder auszugsweisen Kopien des Programms zurückzugeben bzw. zu vernichten und dies gegenüber TI schriftlich zu bestätigen.

(2) Der Export oder Reexport des Programms unterliegt den Ausfuhrbestimmungen des Landes, in dem Sie eine Lizenz für das Programm erworben haben, sowie dem United States Export Administration Act von 1969 in der jeweils aktuellen Fassung. Für die Einhaltung dieser Bestimmungen sind Sie verantwortlich. Sie erklären, dass Sie das Programm oder technische Daten weder direkt noch indirekt in ein Land exportieren, reexportieren oder übertragen werden, in das der Export, der Reexport oder die Übertragung durch geltende Gesetze oder Vorschriften des Landes, in dem Sie das Programm erworben haben, oder der USA ohne die ggf. erforderliche entsprechende Zustimmung oder Genehmigung der zuständigen Behörde des Landes, in dem Sie eine Lizenz für das Programm erworben haben, bzw. des Bureau of Industry and Security des US-Handelsministeriums beschränkt sind, und dass Sie auch keine dahin gehenden Absichten verfolgen.

(3) Diese Lizenzvereinbarung unterliegt dem Recht der Bundesrepublik Deutschland und ist dementsprechend auszulegen. Das Wiener Übereinkommen über Verträge über den internationalen Warenkauf findet keine Anwendung.

(4) Wenn eine Bestimmung dieser Lizenzvereinbarung oder ein Teil einer solchen Bestimmung unwirksam ist oder wird, bleiben die übrigen Bestimmungen und der übrige Teil der betreffenden Bestimmung sowie der Lizenzvereinbarung wirksam. Die unwirksame Bestimmung wird durch eine solche ersetzt, die dem wirtschaftlich Gewollten der Parteien in zulässiger Weise am nächsten kommt.

(5) Diese Lizenzvereinbarung stellt die gesamte Vereinbarung zwischen Ihnen und TI dar. Ergänzungen oder Änderungen dieser Lizenzvereinbarung bedürfen der Schriftform und der Unterschrift eines ordnungsgemäß bevollmächtigten Vertreters von TI. Dies gilt auch für einen etwaigen Verzicht auf dieses Schriftformerfordernis.

(6) Hersteller des Programms ist Texas Instruments Incorporated, 12500 TI Blvd., Dallas, Texas 75243, U.S.A.
